Do it Yourself Bankruptcy

For some people, bankruptcy can be a fairly simple process that can be completed without paying an attorney.  If you cannot afford a lawyer, you can file pro se (without a lawyer). Filing bankruptcy pro se will require knowledge of federal bankruptcy laws and local bankruptcy jurisdiction rules. Most individual consumers can file bankruptcy on their own as long as they have a good reference manual to guide them through the process.

  • Consult a lawyer to answer all legal questions regarding keeping property and any other bankruptcy questions or issues of concern.
  • Gather all documentation needed to complete the bankruptcy petition. (6 months of paycheck advices, prior two year tax returns, monthly expenses, credit card bills, medical bills, property deeds, vehicle titles, installment loan information, pending court paperwork, garnishment/judgment information, etc.)
  • Complete a credit counseling course from an approved credit counseling agency 180 days before you file bankruptcy. 
  • File completed petition and your credit counseling certificate with the bankruptcy court.
  • Attend meeting of creditors.
  • Complete a post-filing Personal Financial Management Instruction Course only after your case is filed and WITHIN 45 DAYS of the creditors meeting. (341 Meeting)

Chapter 7 Filing Fee Waiver

The fee to file for Chapter 7 bankruptcy is currently $335. If you cannot afford to pay this fee up front or in installments, you might qualify for a waiver of the fee. Along with your other bankruptcy forms, you will have to complete and file an Application for Waiver of the Chapter 7 Filing Fee (Form 3B).

Who Qualifies for a Chapter 7 Fee Waiver?

You qualify for a fee waiver if:

you are an individual (businesses cannot apply for fee waivers)

you are filing for Chapter 7 bankruptcy

you cannot pay the fee in installments over 120 days, and
your combined family income is less than 150% of the official poverty line. (See chart below.)

If you cannot afford to pay the fee up front, but can pay in installments, you can file an Application to Pay Filing Fee in Installments.

Chapter 7 Bankruptcy Timeline

-Within 180 days prior to filing bankruptcy: Complete a credit counseling course and receive a certificate of completion.

-0 days: File bankruptcy Chapter 7. A typical bankruptcy petition consists of 60-75 pages of information including the Petition, Schedules and Statement of Affairs.

-14 days after you file bankruptcy: All deficiencies in bankruptcy documentation must be filed with the Court, including schedules of assets and liabilities.

-4-6 weeks after you file bankruptcy: You must attend a mandatory meeting with the bankruptcy trustee to confirm the good faith of your filing. Creditors who wish to object to your bankruptcy filing may appear at this meeting, but this is very rare.

-45 days after your meeting: If you filed a Chapter 7, you must complete a financial management course and the certificate must be filed with the Court for you to receive your discharge.

-60-90 days after meeting: If you filed a Chapter 7, your debts will usually be discharged if no objections are made.

(i) whether the student has been expelled from school attendance at a private school or in a public school division of the Commonwealth or in another state.

(ii) whether the student has been found guilty of or adjudicated delinquent for any offense listed in subsection G of Va. Code Ann. §16.1-260 or any substantially similar offense under the laws of any state, the District of Columbia, or the United States or its territories.

2013 Bankruptcy Filings & Reasons People File

The 2013 bankruptcy statistics reveal that 706,499 people filed Chapter 7 bankruptcy and 330,899 people filed Chapter 13 bankruptcy for non-business consumer debt.  These numbers make up bankruptcy petitions received, terminated, and pending by the U.S. Bankruptcy Courts and reported to the Administrative Office of the U.S. Courts. 

Some of the top reasons people file bankruptcy are:

To stop a foreclosure.    Some people file to save their home from foreclosure if they are behind in their mortgage payments.  They are able to design a Chapter 13 plan that will allow them to get caught up on back mortgage payments.

To stop a repo.  Again, some people are able to design a Chapter 13 plan that will allow them to get caught up on back car note payments or even lower their existing car note.

To eliminate IRS taxes. You may can discharge older tax debts in a Chapter 7 filing.  (Consult with a bankruptcy attorney.)  Chapter 13 bankruptcy can allow you to pay back the debt over 3-5 years.

To eliminate credit card and other unsecured debt.  You may be able to discharge your credit card and other secured debt when filing a Chapter 7.  (Consult with a bankruptcy attorney.)  If you file a Chapter 13, you will pay back a portion of your debt through a court approved payment plan.

Overwhelmed with medical debt.  Medical debt can increase quickly when an unexpected accident or illness occurs.  It can put a strain on your finances if you don't have insurance or under-insured.

Loss of employment.  Let's face it, a job loss can be a devastating blow to anyone.  Some people exhaust all of their savings to keep up with bills while others don't have a savings at all.

Stop harassing phone calls from creditors.  When you are in a bankruptcy, creditors may no longer contact you by phone or by mail.  This is the benefit of the "automatic stay".

What is a QR Code? 

A QR Code , abbreviated for "Quick Response", is a barcode that contains data that can be read by a smartphone's camera using a QR reader/scanner.  QR Codes can contain information about a business such as a website's URL, contact information or even social media platforms.  By scanning a QR code, you will be taken directly to that business' information!
QR Codes have become increasingly popular in advertising and marketing efforts by small business owners too.  This is an easy and great tool to use on business cards, brochures, brand clothing and other print material. By placing your custom QR Code on the back of a business card, you can generate more traffic to your website by providing easy access to a specific page on your website, Facebook business page or Twitter account.

What software do I need to read a QR Code?
There are a ton of QR Code reader and scanner apps that are available for Android and Apple smartphones and tablets.  I personally use QR Reader for iPhone by TapMedia Ltd.  It scans QR codes, barcodes, words and even creates PDF files with the "Scan to PDF" feature.  Most importantly, it's a totally FREE app!
